Terms of Service | APEX NFE AUTO

1. Acceptance

By using apexnfeauto.com or any APEX NFE AUTO INVESTMENT LLC service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the site.

2. Vehicle Offers & Purchases

Online offers are estimates based on the VIN, photos, and information you provide. Final offers are issued after in-person inspection and may be revised if condition or title status differs. Sellers must be the legal title holder with no active lien and present a valid government-issued ID.

3. Financing Applications

Submission of a financing application does not guarantee approval. Approval, APR, term, and down payment are determined by the participating lender(s). "All credit welcome" means we accept applications from all credit profiles; it is not a promise of approval or specific terms.

4. Rentals

Rentals require a separate written rental agreement, valid driver's license, proof of insurance, and a refundable security deposit. Mileage caps, age restrictions, late fees, toll/violation fees, fuel charges, smoking fees, and cleaning fees may apply. Rideshare/delivery use (Uber, Lyft, DoorDash, Amazon Flex, etc.) requires explicit written approval.

5. Rent-to-Own (RTO)

RTO is a lease-to-own arrangement, not a credit transaction. The total of payments exceeds the cash price (typically by $3,000–$4,000). Missed payments may result in late fees, repossession, and forfeiture of payments. Title transfers only upon completion of all scheduled payments and satisfaction of the contract.

6. Deposits & Payments

Deposits are processed by Stripe. Reservations are held for the period stated in your confirmation. Refundable vs non-refundable portions are governed by the deposit agreement. Chargebacks initiated without first contacting us may be disputed.

7. As-Is Sales Disclaimer

Unless explicitly stated in a written warranty, all used vehicles are sold AS-IS with no express or implied warranties of merchantability or fitness for a particular purpose, to the maximum extent permitted by law.

8. Communications

By submitting a form, you authorize us to contact you by phone, SMS, email, and WhatsApp. Message/data rates may apply. Reply STOP to opt out of SMS.

9. Limitation of Liability

To the maximum extent permitted by law, APEX NFE AUTO INVESTMENT LLC is not liable for indirect, incidental, consequential, or punitive damages arising from use of the site or services.

10. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
